1.1. The Online Store available at www.edikson.com is run by EDIKSON WOJCIECH FULARCZYK with its registered office in Gdańsk (registered address and service address: ul. Otomińska, No. 25D, office 2, 80-178 Gdańsk); NIP: 5832923692; REGON: 220325341 and e-mail address: info@edikson.com

 

1.2. These Regulations are addressed to both consumers and entrepreneurs using the Online Store, unless the provisions of the Regulations provide otherwise.

 

1.3. The administrator of personal data processed in the Online Store in connection with the implementation of the provisions of these Regulations is the Seller. Personal data is processed for purposes, for a period and based on the grounds and principles indicated in the privacy policy published on the Online Store website. The privacy policy contains primarily the rules regarding the processing of personal data by the Administrator in the Online Store, including the grounds, purposes and period of personal data processing and the rights of data subjects, as well as information on the use of cookies and analytical tools in the Online Store. Using the Online Store, including making purchases, is voluntary. Similarly, providing personal data by the Service Recipient or Customer using the Online Store is voluntary, subject to the exceptions indicated in the privacy policy (conclusion of the contract and statutory obligations of the Seller).

 

1.4. Definitions:

BLOG - Electronic Service, an online blog available in the Online Store and run by the Service Provider for all visitors to the Online Store. WORKING DAY - one day from Monday to Friday, excluding public holidays.

ORDER FORM - Electronic Service, an interactive form available in the Online Store that allows you to place an Order, in particular by adding Products to the electronic basket and specifying the terms of the Sales Agreement, including the method of delivery and payment.

INQUIRY FORM - Electronic Service, an interactive form available in the Online Store that allows you to send an Inquiry, in particular by adding Products of interest to the Customer to the Inquiry.

CUSTOMER - (1) a natural person with full legal capacity, and in cases provided for by generally applicable regulations, also a natural person with limited legal capacity; (2) a legal person; or (3) an organizational unit without legal personality, which the law grants legal capacity; - which has concluded or intends to conclude a Sales Agreement with the Seller.

CIVIL CODE - the Civil Code Act of April 23, 1964 (Journal of Laws 1964 No. 16, item 93, as amended).

NEWSLETTER - Electronic Service, an electronic distribution service provided by the Service Provider via e-mail, which enables all Users using it to automatically receive from the Service Provider cyclical content of subsequent editions of the newsletter containing information about Products, news and promotions in the Online Store.

OPINIONS - Electronic Service enabling the Users to add opinions and ratings regarding Products and concluded Sales Agreements.

PRODUCT - a movable item or service available in the Online Store, which is the subject of the Sales Agreement between the Customer and the Seller.

REGULATIONS - these regulations of the Online Store.

ONLINE STORE - the Service Provider's online store available at the Internet address: www.edikson.com

SALES AGREEMENT - a Product sales agreement concluded or concluded between the Customer and the Seller via the Online Store.

ELECTRONIC SERVICE - a service provided electronically by the Service Provider to the Service Recipient via the Online Store.

SERVICE RECIPIENT - (1) a natural person with full legal capacity, and in cases provided for by generally applicable regulations, also a natural person with limited legal capacity; (2) a legal person; or (3) an organizational unit without legal personality, which the law grants legal capacity; - using or intending to use the Electronic Service.

ACT ON CONSUMER RIGHTS - the Act of 30 May 2014 on consumer rights (Journal of Laws of 2014, item 827, as amended).

ORDER - Customer's declaration of will submitted via the Order Form and aimed directly at concluding a Product Sales Agreement with the Seller.

INQUIRY - an inquiry from a non-consumer Customer submitted via the Inquiry Form and aimed at obtaining from the Seller an individual offer to conclude a Product Sales Agreement with the Seller.

Right to withdraw from the contract

2.1 A consumer who has concluded a distance contract may withdraw from it within 14 calendar days without giving any reason and without incurring costs (does not apply to cash registers and costs related to the consumer's withdrawal from the contract, which the consumer is obliged to bear). To meet the deadline, it is enough to send a statement before its expiry. A declaration of withdrawal from the contract may be submitted, for example:

-> in electronic form via e-mail to the following address: info@edikson.com

 

2.2. The Seller is obliged to immediately, not later than within 14 calendar days from the date of receipt of the consumer's statement on withdrawal from the contract, return to the consumer all payments made by him, including the costs of delivery of the Product (except for additional costs resulting from the method of delivery chosen by the Customer other than the cheapest standard delivery method available in the Online Store).

 

2.3. The seller refunds the payment using the same method of payment as used by the consumer, unless the consumer has expressly agreed to a different method of return, which does not involve any costs for him. If the Seller has not offered to collect the Product from the consumer himself, he may withhold the reimbursement of payments received from the consumer until he receives the Product back or the consumer provides proof of its return, depending on which event occurs first.

3.1. All products offered in the Store are brand new, free from physical and legal defects, meet EU CE safety requirements and have been legally introduced to the Polish market.

 

3.2 Complaints are subject to goods that do not comply with the contract, based on the provisions of the Act of July 27, 2002 on special conditions of consumer sales and on the amendment of the Civil Code (Journal of Laws No. 141, item 1176).

Complaints regarding non-compliance of the goods with the contract should be submitted in writing to the following e-mail address: info@edikson.com. The customer will be informed by e-mail about the method of settling the complaint. The customer is obliged to deliver the advertised product together with proof of purchase.


3.3 If the complaint is accepted, the Shop, after consultations with the Customer, will deliver the goods repaired or replaced with defect-free goods at the Shop's expense. At the Customer's request, the payment for the returned goods, together with the shipping costs incurred and the costs of delivering the defective product to the store, may be made by bank transfer to the indicated bank account or in cash at the registered office at ul. Otomińska 25D/2 in Gdańsk.

 

3.4 A consumer, within the meaning of Art. 221 of the Civil Code, has the right to submit a complaint within 2 years from the date of purchase, provided that the Store is notified of the defect within two months of finding the non-conformity of the goods with the contract.
